Baco Labs LLC (Official registration: ТОО "Baco Labs")

These Terms of Use (“Agreement”, “Terms”) constitute a legally binding contract between Baco Labs LLC, a limited liability company registered in the Republic of Kazakhstan (“Provider”, “We”, “Us”), and any individual or entity using our mobile applications (“User”, “You”).
By downloading, installing, accessing, or using any Baco Labs mobile application (“Mobile Application”), You confirm that You have read, understood, and agree to be bound by this Agreement. If You do not agree with these Terms, You must immediately delete the Mobile Application and discontinue its use.
1. AGREEMENT AND DEFINITIONS
1.1. Agreement Overview. This Agreement establishes the conditions under which the User may access and use the Mobile Application and Services.
1.2. User Content. Any text, notes, reminders, or prompts created or entered within the Mobile Application.
2. SERVICES AND DISCLAIMERS
2.1. License Grant. Provider grants the User a limited, non-exclusive, non-transferable license for personal and non-commercial purposes.
2.2. Medical Disclaimer. The Mobile Application is an information tool only and does not provide medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider. Baco Labs is not responsible for any health consequences, missed medication, or incorrect dosages resulting from the use or technical failure of the application.
2.3. AI and Generative Content Disclaimer. Services may include features powered by Artificial Intelligence (AI). You acknowledge that:
- AI-generated outputs are experimental and provided "as-is".
- Outputs may be inaccurate, incomplete, or biased.
- Baco Labs does not guarantee the appropriateness of AI advice in sensitive areas (e.g., relationships, mental health).
- Users must exercise their own judgment before acting on any AI-generated suggestions.
3. USER CONTENT AND CONDUCT
3.1. User Responsibility. The User is solely responsible for the legality and accuracy of User Content.
3.2. Prohibited Use. You agree not to use the Mobile Application to create or share content that is illegal, defamatory, or promotes violence/harm.
3.3. Age Restriction. For Applications involving AI-driven interpersonal communication or health monitoring, the User must be at least 16 years of age (or 18, depending on local jurisdiction).
4. FEES AND PAYMENTS
4.1. In-App Purchases. Subscriptions and one-time purchases are processed exclusively via the Apple App Store or Google Play Store.
4.2. Auto-Renewal. Subscriptions renew automatically unless cancelled in your store account settings at least 24 hours before the end of the current period.
4.3. Refunds. All refund requests are handled by Apple/Google according to their respective policies. Baco Labs does not process refunds directly.
5. LIMITATION OF LIABILITY
5.1. "As Is" Basis. The Mobile Application is provided “as is” and “as available” without warranties of any kind.
5.2. No Liability for Data Loss. We use secure cloud infrastructure (Firebase/Supabase), but we do not guarantee that User Content will never be lost. You are responsible for maintaining your own backups.
5.3. Maximum Liability. To the maximum extent permitted by law, Baco Labs' total liability for any claim shall not exceed the amount paid by the User for the Services in the 12 months preceding the claim.
6. GOVERNING LAW AND JURISDICTION
6.1. Governing Law. This Agreement is governed by the laws of the Republic of Kazakhstan.
6.2. Dispute Resolution. Any disputes shall be resolved by the competent courts of the Republic of Kazakhstan. Nothing in these Terms shall deprive the User of the protection afforded by the mandatory consumer protection laws of their country of residence.
7. FINAL PROVISIONS
7.1. Amendments. We may modify these Terms at any time. Continued use of the Application after changes constitutes acceptance.
